2. The provisions under Article 12 paragraph 2 shall apply accordingly to the case of the preceding paragraph.
(Assignment of Concession)
Article 13. Any person who has been granted approval under Article 12 paragraph 1 (hereinafter referred to as “category 1 concessionaire”, or any person who has been granted approval under Article 12-(2) paragraph 1 (hereinafter referred to as “category 2 concessionaire”), shall, when he intends to assign, sublease or consign the concession in part or in whole to a third party, submit an application for approval, in duplicate, to the Director of the Regional Civil Aviation Bureau through the Airport Administrator in the case of the category 1 concessionaires, or to the Airport Administrator in the case of category 2 concessionaires, giving the following information:
(1)Name and address;
(2)Name and address of the third party to whom the above assignment, sublease or consignment is proposed;
(3)Type of business for which the assignment, sublease or consignment is proposed;
(4)Reasons for assignment, sublease or consignment;
(5)Outline of the business, if any, currently being managed by the third party
2. The application under the preceding paragraph shall be accompanied by the following documentation in relation to the third party:
(1)Articles of association or acts of donation (or abstract of the third party's family records, if the third party is not a juridical person);
(2)Copy of commercial register, latest balance sheet and income statement (or a certificate attesting to assets or tax payment, if the third party is not a juridical person).
3. The provisions under Article 7 paragraph 3 shall apply accordingly to the approval under paragraph 1.
4. Any person who has filed an application in accordance with the provisions of paragraph 1 of the preceding Article (hereinafter referred to as “category 3 concessionaires”), shall, when he intends to assign, sublease or consign the concession granted to him in part or in whole to a third party, submit in advance to the Airport Administrator the information specified under each subparagraph of paragraph 1.
5. The provisions under paragraph 2 shall apply accordingly to the case of the preceding paragraph.
